SCANDIC ASSETS FZCO is the holding company and owner of trademarks; operational and all responsible activities are carried out by SCANDIC TRUST GROUP TOV (LLC).

2. Categories of personal data

We process different categories of personal data depending on the service used:

  • Master data such as name, address, contact details, date of birth and identification (e.g. ID details) for customer identification.
  • Contract and payment data such as bank details, transaction histories, crowdfunding participations and billing.
  • Usage Data our digital platforms, including IP addresses, log files, device and browser information, and communication content.
  • Health and fitness dataif you use medical or wellness services and expressly consent.
  • Data from business partners and suppliers, such as commercial register entries, contact persons and creditworthiness information.

3. Purposes and legal basis of processing

Your data will be processed for the following purposes and on the relevant legal bases:

  • Fulfillment of contract (Article 6(1b) GDPR): for example, to process payments, provide our services or manage memberships.
  • Fulfillment of legal obligations (Article 6(1c) GDPR): for example, compliance with retention periods, money laundering and financial market regulations.
  • Safeguarding legitimate interests (Article 6(1f) GDPR): among other things, to improve services, for IT security, to assert legal claims or to prevent fraud. Our interest is to make our offerings safe, efficient and market-compliant.
  • Consent (Art. 6 Para. 1a GDPR): for specific purposes such as sending marketing newsletters, using cookies or processing special categories of personal data (health data). Consent given can be revoked at any time.

4. Recipient of the data

We only share personal data if there is a legal basis and it is necessary:

  • Within the SCANDIC GROUP to affiliated companies if they provide services (e.g. payment processing, customer service).
  • To external service providers such as IT providers, KYC service providers, payment service providers, banks, logistics and shipping companies as well as marketing agencies that work on our behalf and are contractually obliged to maintain confidentiality.
  • To authorities and public bodiesif required by law, for example to tax and regulatory authorities, law enforcement authorities or courts.
  • To cooperation partners (e.g. travel and mobility partners) as part of joint offers, provided you have agreed to this or there is a legal basis.

5. International data transfer

The SCANDIC GROUP operates infrastructure and services worldwide. Personal data will only be transferred to countries outside the European Union (e.g. United Arab Emirates, USA) if appropriate guarantees to protect the data exist. We use, among other things, standard contractual clauses from the EU Commission, binding internal data protection rules or adequacy decisions. We will inform you separately about processing operations in third countries.

6. Storage period and deletion

Personal data will only be stored for as long as is necessary to fulfill the purposes or as required by legal retention periods. Once the purpose no longer applies or the deadline has expired, the data will be deleted or anonymized. Commercial and tax documents are stored for at least six or ten years in accordance with Sections 257 of the German Commercial Code (HGB) and Section 147 of the AO, and payment transaction data for five years in accordance with financial supervisory law.

7. Rights of data subjects

You have the following rights under the GDPR:

  • Right to information about the data we store, its origin and recipient as well as the purpose of processing.
  • Right to rectification incorrect or incomplete data.
  • Right to deletion personal data (“right to be forgotten”), provided there are no legal retention periods to the contrary.
  • Right to restriction of processing.
  • Right to data portability, d. h. Publication of data in a structured, common format.
  • Right to object against processing for reasons arising from your particular situation; this particularly applies to direct advertising.
  • Right not to be subject to a decision based solely on automated processing.

10. Minors

Our offers are not aimed at children under 16 years of age. If we become aware that personal data of minors has been processed without the consent of their legal guardian, we will delete it immediately. Parents and legal guardians can contact us if they suspect that their children are using our services.

We regularly review this privacy policy and adapt it if legal, technical or business changes occur. The current version will be published on our website. Changes will typically be announced 30 days before they take effect.
